Legal information
Webdesign Agentur Rauen · Version on the existing website: June 2026.
These general terms and conditions apply to all contracts between Webdesign Agentur Rauen and its clients for webdesign, development, hosting, maintenance, consulting and other digital services.
Different client terms apply only if expressly confirmed by Webdesign Agentur Rauen in text form.
A contract is formed when Webdesign Agentur Rauen makes an offer and the client accepts it, or when the agency begins providing the service following prior agreement.
Offers are non-binding unless expressly designated as binding.
The specific scope of services is defined in the relevant offer, order confirmation or separate service description.
Additional services that have not been expressly agreed are not part of the contract and are charged separately.
The client provides all content, access credentials, text, images, videos, logos and other materials needed for the project promptly, completely and in a usable form.
Content supplied by the client is not reviewed for copyright, trademark, personality rights or data protection issues.
The client alone is liable for legal defects, infringements or other claims arising from content supplied by the client.
Fees are based on the agreed offer.
Unless otherwise agreed, invoices are payable without deduction within 14 days of the invoice date.
For larger projects, Webdesign Agentur Rauen may request reasonable instalments or advance payments.
Where acceptance is required, the client must inspect the work promptly after handover.
The work is deemed accepted if the client does not report material defects in text form within 10 working days of handover. Minor deviations that do not materially impair use do not entitle the client to refuse acceptance.
Revision rounds agreed in the offer are included to the specified extent.
Further changes requested after approval of the concept, design or implementation count as additional services and are charged separately.
After full payment, the client receives a non-exclusive right to use the work created individually for them for the agreed purpose, unless otherwise agreed.
Editable source files, raw data, working files and preliminary work not expressly commissioned remain with Webdesign Agentur Rauen unless agreed otherwise.
Webdesign Agentur Rauen may refer to the collaboration in an appropriate manner as a reference, unless the client objects in text form.
Where hosting, maintenance or technical support services are agreed, their type and scope are determined by the relevant offer.
Webdesign Agentur Rauen is liable for external providers’ services only within the scope of its own contractual obligations.
Webdesign Agentur Rauen is liable only for damage caused by intentional or grossly negligent breaches of duty.
In cases of ordinary negligence, Webdesign Agentur Rauen is liable only for breaches of essential contractual obligations and only for foreseeable damage typical of the contract.
Liability for content supplied or approved by the client is excluded.
The client alone is liable for third-party claims arising from such content.
Further liability is excluded to the extent permitted by law.
The client warrants that they hold all necessary rights to the content they supply. Webdesign Agentur Rauen is not obliged to check that content for third-party rights or legal admissibility.
The client indemnifies Webdesign Agentur Rauen against all third-party claims arising from the use of such content.
Both parties agree to keep confidential information learned during the collaboration confidential and to use it only to perform the contract.
This obligation continues after the contract ends.
Where Webdesign Agentur Rauen processes personal data in performing the contract, it does so only to the extent necessary to fulfil the contract.
The client is responsible for the lawfulness of the content and data they transmit.
The law of the Federal Republic of Germany applies.
To the extent permitted by law, the place of jurisdiction is the registered office of Webdesign Agentur Rauen.
If individual provisions of these terms are or become wholly or partly invalid, the validity of the remaining provisions is unaffected.
